Error in the CIRBE

If your company appears in the Central Credit Register of the Bank of Spain (CIRBE) as a debtor by mistake, how can you claim for those data to be rectified by the banking entity?  

Well, first of all, you must go to the entity that provided that incorrect information (reporting entity) to the CIRBE to rectify or cancel the data it contains. To this end:

• A claim must be submitted to the customer service of the entity with the reasons for the request and attaching the documentation that proves the error (for example, the loan cancellation deed).
• The maximum period for the entity to respond is one month from the submission.

If the entity does not respond or does not agree to rectify, you must go to the Claims Service of the Bank of Spain (BE). From here:

• The BE will transfer the request to the entity, which must respond within 15 business days if the interested party is a natural person or 20 business days if it is a legal entity.
• If the banking entity agrees to the rectification, it must immediately inform the CIRBE.

If it does not rectify, a lawsuit must be filed to request the judicial declaration of the existence of the error, as well as its rectification by the banking entity. Likewise, if applicable, compensation may be requested for the possible damages caused by the incorrect data or for the violation of the right to honor.
